Welcome to Ekaveer!


Ekaveer builds technologies and services that enable people to connect, build communities and grow businesses. These Terms govern your use of Ekaveer and the other products, features, apps, services, technologies and software that we offer, except where we expressly state that separate terms (and not these) apply. These Products are provided to you by Ekaveer, Inc.

We don't charge you to use Personal Role of Ekaveer and services covered by these Terms. Instead, Businesses and Organisations which use Business Role of Ecaveer pay us to show you ads for their products and services. By using our Products, you agree that we can show you ads that we think will be relevant to you and your interests. We use your personal data to help determine which ads to show you.

We don't sell your personal data to advertisers, and we don't share information that directly identifies you (such as your name, email address or other contact information) with advertisers unless you give us specific permission. Instead, advertisers can tell us things such as the kind of audience that they want to see their ads, and we show those ads to people who may be interested in. We provide advertisers with reports about the performance of their ads that help them understand how people are interacting with their content. See Section 2 below to learn more.

1. The services we provide

Our mission is to give people the power to build community and bring the world closer together. To help advance this mission, we provide the products and services described below to you:
 
Provide a personalised experience for you:
Your experience on Ekaveer is unlike anyone else's: from the posts, stories, events, blogs, ads and other content that you see in News Feed or our video platform to the Pages that you follow and other features that you might use, such as Booking,
e-commerce and search. We use the data that we have – for example, about the connections you make, the choices and settings you select, and what you share and do on and off our Products – to personalise your experience.
 
Connect you with people and organisations that you care about:
We help you find and connect with people, groups, businesses, organisations and others that matter to you across the Ekaveer products that you use. We use the data that we have to make suggestions for you and others – for example, groups to join, events to attend, Pages to follow or send a message to, shows to watch and people who you may want to become friends with. Stronger ties make for better communities, and we believe that our services are most useful when people are connected to people, groups and organisations that they care about.
 
Empower you to express yourself and communicate about what matters to you:
There are many ways to express yourself on Ekaveer and to communicate with friends, family and others about what matters to you – for example, sharing status updates, photos, videos and stories across the Ekaveer Products that you use, sending messages to a friend or several people, creating events or groups, or adding content to your profile. We have also developed, and continue to explore, new ways for people to use technology, such as augmented reality and 360 videos to create and share more expressive and engaging content on Ekaveer.
 
Help you discover content, products and services that may interest you:
We show you ads, offers, and other sponsored content to help you discover content, products, and services that are offered by the many businesses and organisations that use Ekaveer and other Ekaveer Products. 
 
Combat harmful conduct, and protect and support our community:
People will only build a community on Ekaveer if they feel safe. We employ dedicated teams around the world and develop advanced technical systems to detect misuse of our Products, harmful conduct towards others and situations where we may be able to help support or protect our community. If we learn of content or conduct like this, we will take appropriate action – for example, offering help, removing content, removing or restricting access to certain features, disabling an account or contacting law enforcement. We share data with other our companies when we detect misuse or harmful conduct by someone using one of our Products.
 
Use and develop advanced technologies to provide safe and functional services for everyone:
We use and develop advanced technologies such as artificial intelligence, machine learning systems and augmented reality so that people can use our Products safely regardless of physical ability or geographic location. For example, technology such as this helps people who have visual impairments understand what or who is in photos or videos shared on Ekaveer. We also build sophisticated network and communication technology to help more people connect to the Internet in areas with limited access. And we develop automated systems to improve our ability to detect and remove abusive and dangerous activity that may harm our community and the integrity of our Products.
 
Research ways to make our services better:
We engage in research to develop, test and improve our Products. This includes analysing the data we have about our users and understanding how people use our Products, for example by conducting surveys and testing and troubleshooting new features. 
 
Provide consistent and seamless experiences across the Ekaveer Company Products:
Our Products help you find and connect with people, groups, businesses, organisations and others that are important to you. We design our systems so that your experience is consistent and seamless across the different Ekavver Company Products that you use.

2. How our services are funded

Instead of paying to use Personal Role of Ekaveer and the other products and services we offer, by using the Ekaveer Products covered by these Terms, you agree that we can show you ads that businesses and organisations wich use Business Role of Ecaveer pay us to promote on and off the Ekaveer Company Products. We use your personal data, such as information about your activity and interests, to show you ads that are more relevant to you.
 
Protecting people's privacy is central to how we've designed our ad system. This means that we can show you relevant and useful ads without telling advertisers who you are. We don't sell your personal data. We allow advertisers to tell us things such as their business goal, and the kind of audience that they want to see their ads (for example, people between the ages of 18-35 who like cycling). We then show their ad to people who might be interested.
 
We also provide advertisers with reports about the performance of their ads to help them understand how people are interacting with their content on and off Ekaveer. For example, we provide general demographic and interest information to advertisers (for example, that an ad was seen by a woman between the ages of 25 and 34 who lives in London and likes software engineering) to help them better understand their audience. We don't share information that directly identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us specific permission.

3. Your commitments to Ekaveer and our community

We provide these services to you and others to help advance our mission. In exchange, we need you to make the following commitments:
 
1. Who can use Ekaveer
When people stand behind their opinions and actions, our community is safer and more accountable. For this reason, you must:
  • use the same name that you use in everyday life;
  • provide accurate information about yourself;
  • create only one account (your own) and use your timeline for personal purposes; and
  • not share your password, give access to your Ekaveer account to others or transfer your account to anyone else (without our permission).
 
We try to make Ekaveer broadly available to everyone, but you cannot use Ekaveer if:
  • You are under 13 years old (or the minimum legal age in your country to use our Products).
  • You are a convicted sex offender.
  • We've previously disabled your account for violations of our Terms or Policies.
  • You are prohibited from receiving our products, services or software under applicable laws.
 
2. What you can share and do on Ekaveer
We want people to use Ekaveer to express themselves and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of our community. You, therefore, agree not to engage in the conduct described below (or to facilitate or support others in doing so):
 
1. You may not use our Products to do or share anything:
  • That breaches these Terms, our Community Standards, and other Terms and Policies that apply to your use of Ekaveer.
     
  • That is unlawful, misleading, discriminatory or fraudulent.
     
  • That infringes or violates someone else's rights, including their intellectual property rights.

2. You may not upload viruses or malicious code, or do anything that could disable, overburden or impair the proper working or appearance of our Products.

3. You may not access or collect data from our Products using automated means (without our prior permission) or attempt to access data that you do not have permission to access.

 
We can remove or restrict access to content that violates these provisions.
 
If we remove content that you have shared in violation of our Community Standards, we'll let you know and explain any options you have to request another review unless you seriously or repeatedly violate these Terms or if doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.
 
To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies.
 
We also can remove or restrict access to your content, services or information if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts to Ekaveer.
 
3. The permissions you give us
 
 
We need certain permissions from you to provide our services:

1. Permission to use content that you create and share: Some content that you share or uploads, such as photos or videos, may be protected by intellectual property laws.

You own the intellectual property rights (things such as copyright or trademarks) in any such content that you create and share on Ekaveer and the other Ekaveer Company Products you use. Nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want.

However, to provide our services, we need you to give us some legal permissions (known as a ‘licence') to use this content. This is solely to provide and improve our products and services as described in Section 1 above.

Specifically, when you share, post or upload content that is covered by intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free and worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you share a photo on Ekaveer, you give us permission to store, copy and share it with others (again, consistent with your settings) such as service providers that support our service or other Ekaveer Products you use. This licence will end when your content is deleted from our systems.

You can delete content individually or all at once by deleting your account. You can download a copy of your data at any time before deleting your account.

When you delete content, it's no longer visible to other users; however, it may continue to exist elsewhere on our systems where:

    • Immediate deletion is not possible due to technical limitations (in which case, your content will be deleted within a maximum of 90 days from when you delete it);
    • your content has been used by others following this licence, and they have not deleted it (in which case, this licence will continue to apply until that content is deleted); or
    • Where immediate deletion would restrict our ability to:
    • investigate or identify illegal activity or breaches of our Terms and Policies (for example, to identify or investigate misuse of our Products or systems);
    • comply with a legal obligation, such as the preservation of evidence; or
    • comply with a request of judicial or administrative authority, law enforcement or a government agency; in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis). In each of the above cases, this licence will continue until the content has been fully deleted.
 

2. Permission to use your name, profile picture and information about your actions with ads and sponsored content: You permit us to use your name and profile picture and information about actions that you have taken on Ekaveer next to or in connection with ads, offers and other sponsored content that we display across our Products, without any compensation to you. For example, we may show your friends that you are interested in an advertised event or have liked a Page created by a brand that has paid us to display its ads on Ekaveer. Ads like this can be seen only by people who have your permission to see the actions that you've taken on Ekaveer.

3. Permission to update software that you use or download: If you download or use our software, you give us permission to download and install updates to the software where available.

 
4. Limits on using our intellectual property
If you use content covered by intellectual property rights that we have and make available in our Products (for example, images, designs, videos or sounds that we provide, which you add to the content that you create or share on Ekaveer), we retain all rights to that content (but not yours). You can only use our copyrights or trademarks (or any similar marks) as expressly permitted by our Brand Usage Guidelines or with our prior written permission. You must obtain our written permission (or permission under an open-source licence) to modify, create derivative works of, decompile or otherwise attempt to extract source code from us.
 
 

4. Additional provisions

 
1. Updating our Terms
We work constantly to improve our services and develop new features to make our Products better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices. We will only make changes if the provisions are no longer appropriate or if they are incomplete, and only if the changes are reasonable and take due account of your interests.
 
We will notify you (for example, by email or through our Products) at least 30 days before we make changes to these Terms and allow you to review them before they go into effect unless changes are required by law. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products.
 
We hope that you will continue using our Products, but if you do not agree to our updated Terms and no longer want to be part of the Ekaveer community, you can delete your account at any time.
 
2. Account suspension or termination
We want Ekaveer to be a place where people feel welcome and safe to express themselves and share their thoughts and ideas.
 
If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies, including in particular our Community Standards, we may suspend or permanently disable access to your account. We may also suspend or disable your account if you repeatedly infringe other people's intellectual property rights or where we are required to do so for legal reasons.
 
Where we take such action, we'll let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; or where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.
 
If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the following provisions will remain in place: 3, 4.2-4.5.
 
3. Limits on liability
We work hard to provide the best Products we can and to specify clear guidelines for everyone who uses them. Our Products, however, are provided "as is", and we make no guarantees that they will always be safe, secure or error-free, or that they will function without disruptions, delays or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content that they share (including offensive, inappropriate, obscene, unlawful and other objectionable content).
 
We cannot predict when issues may arise with our Products. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstances will we be liable to you for any lost profits, revenues, information or data, or consequential, special, indirect, exemplary, punitive or incidental damages arising out of or related to these Terms or the Ekaveer Products, even if we have been advised of the possibility of such damages.
 
4. Disputes
We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it's useful to know up front where it can be resolved and what laws will apply.
 
If you are a consumer, the laws of the country in which you reside will apply to any claim, cause of action or dispute that you have against us that arises out of or relates to these Terms or the Ekaveer Products, and you may resolve your claim in any competent court in that country that has jurisdiction over the claim. In all other cases, you agree that the claim must be resolved exclusively in the court located in the country of our origin. You also agree that you submit to the personal jurisdiction of either of these courts to litigate any such claim.
 
5. Other
  1. These Terms (formerly known as the Statement of Rights and Responsibilities) make up the entire agreement between you and Ekaveer, Inc. regarding your use of our Products. They supersede any prior agreements.
     
  2. Some of the products that we offer are also governed by supplemental terms. If you use any of those Products, supplemental terms will be made available and will become part of our agreement with you. For instance, if you access or use our Products for commercial or business purposes, such as buying ads, selling products, developing apps, managing a group or Page for your business, or using our measurement services, you must agree to our Commercial Terms. If you post or share content containing music, you must comply with our Music Guidelines. To the extent that any supplemental Terms conflict with these Terms, the supplemental terms shall govern to the extent of the conflict.
     
  3. If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.
     
  4. You will not transfer any of your rights or obligations under these Terms to anyone else without our consent.
     
  5. You may designate a person (called a legacy contact) to manage your account if it is memorialised. Only your legacy contact or a person who you have identified in a valid will or similar document expressing clear consent to disclose your content upon death or incapacity will be able to seek disclosure from your account after it is memorialised.
     
  6. These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition or sale of assets, or by operation of law or otherwise.
     
  7. You should know that we may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name that you use in everyday life). We will inform you in advance if we have to do this and explain why.
     
  8. We always appreciate your feedback and other suggestions about our products and services. But you should know that we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.
     
  9. We reserve all rights not expressly granted to you.

       

5. Other Terms and Policies that may apply to you

           

Community Standards

 

INTRODUCTION

 

Every day, people use Ekaveer to share their experiences, connect with friends and family, and build communities. We are a service for few millions people to freely express themselves across countries and cultures and in dozens of languages.

We recognise how important it is for Ekaveer to be a place where people feel empowered to communicate, and we take our role seriously in keeping abuse of our service. That's why we've developed a set of Community Standards that outline what is and is not allowed on Ekaveer. Our policies are based on feedback from our community and the advice of experts in fields such as technology, public safety and human rights. To ensure that everyone's voice is valued, we take great care to craft policies that are inclusive of different views and beliefs, in particular those of people and communities that might otherwise be overlooked or marginalised.

REITERATING OUR COMMITMENT TO VOICE

The goal of our Community Standards has always been to create a place for expression and give people a voice. This has not and will not change. Building community and bringing the world closer together depends on people's ability to share diverse views, experiences, ideas and information. We want people to be able to talk openly about the issues that matter to them, even if some may disagree or find them objectionable. In some cases, we allow content for public awareness which would otherwise go against our Community Standards – if it is newsworthy and in the public interest. We only do this after weighing the public interest value against the risk of harm and we look to international human rights standards to make these judgments. As such, we consider the newsworthiness of content posted by anyone, including news organisations and individuals users. For example, we have allowed content that graphically depicts war or the consequences of war where it is important to public discourse.

Our commitment to expression is paramount, but we recognise that the Internet creates new and increased opportunities for abuse. For these reasons, when we limit expression, we do it in service of one or more of the following values:

Authenticity: We want to make sure that the content people are seeing on Ekaveer is authentic. We believe that authenticity creates a better environment for sharing, and that's why we don't want people using Ekaveer to misrepresent who they are or what they're doing.

Safety: We are committed to making Ekaveer a safe place. An expression that threatens people has the potential to intimidate, exclude or silence others and isn't allowed on Ekaveer.

Privacy: We are committed to protecting personal privacy and information. Privacy gives people the freedom to be themselves and to choose how and when to share on Ekaveer and to connect more easily.

Dignity: We believe that all people are equal in dignity and rights. We expect that people will respect the dignity of others and not harass or degrade others.

Our Community Standards apply to everyone, all around the world, and to all types of content. They're designed to be comprehensive – for example, content that might not be considered hateful may still be removed for violating a different policy. We recognise that words mean different things or affect people differently depending on their local community, language or background. We work hard to account for these nuances while also applying our policies consistently and fairly to people and their expression. Our enforcement of these standards relies on information available to us. In some cases, this means that we may not detect content and behaviour that violates these standards, and in others, enforcement may be limited to circumstances where we have been provided with additional information and context.

People can report potentially violating content, including Pages, groups, profiles, individual content and comments. We also give people control over their own experience by allowing them to block, unfollow or hide people and posts.

The consequences for violating our Community Standards vary depending on the severity of the violation and the person's history on the platform. For instance, we may warn someone for a first violation, but if they continue to violate our policies, we may restrict their ability to post on Ekaveer or disable their profile. We may also notify law enforcement when we believe that there is a genuine risk of physical harm or a direct threat to public safety.

Our Community Standards are a guide for what is and isn't allowed on Ekaveer. It is in this spirit that we ask members of the Ekaveer community to follow these guidelines.

Please note that the US English version of the Community Standards reflects the most up-to-date set of the policies and should be used as the master document.

 

VIOLENCE AND CRIMINAL BEHAVIOUR

 

 1. Violence and incitement

We aim to prevent potential offline harm that may be related to content on Ekaveer. While we understand that people commonly express disdain or disagreement by threatening or calling for violence in non-serious ways, we remove language that incites or facilitates serious violence. We remove content, disable accounts and work with law enforcement when we believe that there is a genuine risk of physical harm or direct threats to public safety. We also try to consider the language and context to distinguish casual statements from content that constitutes a credible threat to public or personal safety. In determining whether a threat is credible, we may also consider additional information such as a person's public visibility and the risks to their physical safety.

In some cases, we see aspirational or conditional threats directed at terrorists and other violent actors (e.g. terrorists deserve to be killed), and we deem those as non-credible absent-specific evidence to the contrary.

2. Dangerous individuals and organisations

To prevent and disrupt real-world harm, we do not allow any organisations or individuals that proclaim a violent mission or are engaged in violence to have a presence on Ekaveer. This includes organisations or individuals involved in the following:

Terrorist activity

Organised hate

Mass murder (including attempts) or multiple murder

Human trafficking

Organised violence or criminal activity

We also remove content that expresses support or praise for groups, leaders or individuals involved in these activities.

3.Coordinating harm and publicising crime

To prevent and disrupt offline harm and copycat behaviour, we prohibit people from facilitating, organising, promoting or admitting to certain criminal or harmful activities targeted at people, businesses, property or animals. We allow people to debate and advocate for the legality of criminal and harmful activities, as well as draw attention to harmful or criminal activity that they may witness or experience as long as they do not advocate for or coordinate harm.

4. Regulated goods

To encourage safety and compliance with common legal restrictions, we prohibit attempts by individuals, manufacturers and retailers to purchase, sell or trade non-medical drugs, pharmaceutical drugs and marijuana. We also prohibit the purchase, sale, gifting, exchange and transfer of firearms, including firearm parts or ammunition, between private individuals on Ekaveer. Some of these items are not regulated everywhere; however, because of the borderless nature of our community, we try to enforce our policies as consistently as possible. Firearm shops and online retailers may promote items available for sale of our services as long as those retailers comply with all applicable laws and regulations. We allow discussions about sales of firearms and firearm parts in shops or by online retailers and advocating for changes to firearm regulation. Regulated goods that are not prohibited by our Community Standards may be subject to our more stringent Commerce Policies.

5. Fraud and deception

To prevent fraudulent activity that can harm people or businesses, we remove content that purposefully deceives, wilfully misrepresents, or otherwise defrauds or exploits others for money or property. This includes content that seeks to coordinate or promote these activities using our services.

We allow people to raise awareness and educate others as well as condemn these activities.

 

SAFETY

 

6.Suicide and self-injury

We care deeply about the safety of the people who use our apps. We regularly consult with experts in suicide and self-injury to help inform our policies and enforcement and work with organisations around the world to assist people in distress.

While we don't allow people to intentionally or unintentionally celebrate or promote suicide or self-injury, we do allow people to discuss these topics because we want Ekaveer to be a space where people can share their experiences, raise awareness about these issues and seek support from one another.

We define self-injury as the intentional and direct injuring of the body, including self-mutilation and eating disorders. We remove any content that encourages suicide or self-injury, including fictional content such as memes or illustrations and any self-injury content that is graphic, regardless of context. We also remove content that identifies and negatively targets victims or survivors of suicide or self-injury seriously, humorously or rhetorically, as well as real-time depictions of suicide or self-injury. Content about the recovery of suicide or self-harm that is allowed, but may contain imagery that could be upsetting, such as a healed scar, is placed behind a sensitivity screen.

When people post or search for suicide or self-injury- related content, we will direct them to local organisations that can provide support and if someone is at immediate risk of harming themselves, we will contact local emergency services to get them help.

Concerning living content, experts have told us that if someone is saying they intend to attempt suicide on a live-stream, we should leave the content up for as long as possible, because the longer someone is talking to a camera, the more opportunity there is for a friend or family member to call emergency services.

However, to minimise the risk of others being negatively affected by viewing this content, we will stop the live-stream at the point at which the threat turns into an attempt. As mentioned above, in any case, we will contact the emergency services if we identify that someone is at immediate risk of harming themselves.

7. Child sexual exploitation, abuse and nudity

We do not allow content that sexually exploits or endangers children. When we become aware of apparent child exploitation, we report it to the National Center for Missing and Exploited Children (NCMEC), in compliance with applicable law. We know that sometimes, people share nude images of their own children with good intentions; however, we generally remove these images because of the potential for abuse by others and to help avoid the possibility of other people reusing or misappropriating the images.

We also work with external experts, including the Ekaveer Safety Advisory Board, to discuss and improve our policies and enforcement around online safety issues, especially about children. Learn more about the technology we're using to fight against child exploitation.

8. Sexual exploitation of adults

We recognise the importance of Ekaveer as a place to discuss and draw attention to sexual violence and exploitation. To create space for this conversation and promote a safe environment, we allow victims to share their experiences but remove content that depicts, threatens or promotes sexual violence, sexual assault or sexual exploitation. We also remove content that displays, advocates for or coordinates sexual acts with non-consenting parties to avoid facilitating non-consensual sexual acts.

To protect victims and survivors, we remove images that depict incidents of sexual violence and intimate images shared without the consent of the person(s) pictured. As noted in the introduction, we also work with external safety experts to discuss and improve our policies and enforcement around online safety issues, and we may remove content when they provide information that content is linked to harmful activity. We've written about the technology we use to protect against intimate images and the research that has informed our work. 9.Bullying and harassment

Bullying and harassment happen in many places and come in many different forms, from making threats to releasing personally identifiable information, to sending threatening messages and making unwanted malicious contact. We do not tolerate this kind of behaviour because it prevents people from feeling safe and respected on Ekaveer.

We distinguish between public figures and private individuals because we want to allow discussion, which often includes critical commentary of people who are featured in the news or who have a large public audience. For public figures, we remove severe attacks as well as certain attacks where the public figure is directly tagged in the post or comment. For private individuals, our protection goes further: we remove content that's meant to degrade or shame, including, for example, claims about someone's sexual activity. We recognise that bullying and harassment can have more of an emotional impact on minors, which is why our policies provide heightened protection for users between the ages of 13 and 18.

Context and intent matter and we allow people to post and share if it is clear that something was shared to condemn or draw attention to bullying and harassment. In certain instances, we require self-reporting because it helps us understand that the person targeted feels bullied or harassed. In addition to reporting such behaviour and content, we encourage people to use tools available on Ekaveer to help protect against it.

We also have a Bullying Prevention Hub, which is a resource for teenagers, parents and educators seeking support for issues related to bullying and other conflicts. It offers step-by-step guidance, including information on how to start important conversations about bullying.

10.Human exploitation

After consulting with outside experts from around the world, we are consolidating several existing exploitation policies that were previously housed in different sections of the Community Standards into one dedicated section that focuses on human exploitation and captures a broad range of harmful activities that may manifest on our platform. Experts think and talk about these issues under one umbrella – human exploitation.

To disrupt and prevent harm, we remove content that facilitates or coordinates the exploitation of humans, including human trafficking. We define human trafficking as the business of depriving someone of liberty for profit. It is the exploitation of humans to force them to engage in commercial sex, labour or other activities against their will. It relies on deception, force and coercion, and degrades humans by depriving them of their freedom while economically or materially benefiting others.

Human trafficking is multi-faceted and global; it can affect anyone regardless of age, socioeconomic background, ethnicity, gender or location. It takes many forms, and any given trafficking situation can involve various stages of development. By the coercive nature of this abuse, victims cannot consent.

While we need to be careful not to conflate human trafficking and smuggling, the two can be related and exhibit overlap. The United Nations defines human smuggling as the procurement or facilitation of illegal entry into a state across international borders. Without the necessity for coercion or force, it may still result in the exploitation of vulnerable individuals who are trying to leave their country of origin, often in pursuit of a better life. Human smuggling is a crime against a state, relying on movement, and human trafficking is a crime against a person, relying on exploitation.

11.Privacy violations and image privacy rights

Privacy and the protection of personal information are fundamentally important values for Ekaveer. We work hard to safeguard your personal identity and information and we do not allow people to post personal or confidential information about yourself or of others.

We remove content that shares, offers or solicits personally identifiable information or other private information that could lead to physical or financial harm, including financial, residential and medical information, as well as private information obtained from illegal sources.

We also provide people with ways to report imagery that they believe to violate their privacy rights.

 

OBJECTIONABLE CONTENT

 

12.Hate speech

We believe that people use their voice and connect more freely when they don't feel attacked based on who they are. That's why we don't allow hate speech on Ekaveer. It creates an environment of intimidation and exclusion, and in some cases may promote offline violence.

We define hate speech as a direct attack against people based on what we call protected characteristics: race, ethnicity, national origin, disability, religious affiliation, caste, sexual orientation, sex, gender identity and serious disease. We define attacks as violent or dehumanising speech, harmful stereotypes, statements of inferiority, expressions of contempt, disgust or dismissal, cursing and calls for exclusion or segregation. We consider age a protected characteristic when referenced along with another protected characteristic. We also protect refugees, migrants, immigrants and asylum seekers from the most severe attacks, though we do allow commentary and criticism of immigration policies. Similarly, we provide some protections for characteristics such as occupation, when they're referenced along with a protected characteristic.

We recognise that people sometimes share content that includes someone else's hate speech to condemn it or raise awareness. In other cases, speech that might otherwise violate our standards can be used self-referentially or in an empowering way. Our policies are designed to allow room for these types of speech, but we require people to clearly indicate their intent. If the intention is unclear, we may remove content.

13. Violent and graphic content

We remove content that glorifies violence or celebrates the suffering or humiliation of others because it may create an environment that discourages participation. We allow graphic content (with some limitations) to help people raise awareness about issues. We know that people value the ability to discuss important issues such as human rights abuses or acts of terrorism. We also know that people have different sensitivities concerning graphic and violent content. For that reason, we add a warning label to especially graphic or violent content so that it is not available to people under the age of eighteen and so that people are aware of the graphic or violent nature before they click to see it.

14. Adult nudity and sexual activity

We restrict the display of nudity or sexual activity because some people in our community may be sensitive to this type of content. Additionally, we default to removing sexual imagery to prevent the sharing of non-consensual or underage content. Restrictions on the display of sexual activity also apply to digitally created content unless it is posted for educational, humorous or satirical purposes.

Our Nudity Policies have become more nuanced over time. We understand that nudity can be shared for a variety of reasons, including as a form of protest, to raise awareness about a cause or for educational or medical reasons. Where such intent is clear, we make allowances for the content. For example, while we restrict some images of female breasts that include the nipple, we allow other images, including those depicting acts of protest, women actively engaged in breastfeeding and photos of post-mastectomy scarring. For images depicting visible genitalia or the anus in the context of birth and after-birth moments or health-related situations, we include a warning label so that people are aware that the content may be sensitive. We also allow photographs of paintings, sculptures and other art that depicts nude figures.

15. Sexual solicitation

As noted in Section 8 of our Community Standards (Sexual Exploitation of Adults), people use Ekaveer to discuss and draw attention to sexual violence and exploitation. We recognise the importance of and want to allow for this discussion. We draw the line, however, when content facilitates, encourages or coordinates sexual encounters or commercial sexual services between adults such as prostitution or escort services. We do this to avoid facilitating transactions that may involve trafficking, coercion and non-consensual sexual acts. We also restrict sexually explicit language that may lead to solicitation because some audiences within our global community may be sensitive to this type of content and it may impede the ability for people to connect with their friends and the broader community.

16. Cruel and insensitive

We believe that people share and connect more freely when they do not feel targeted based on their vulnerabilities. As such, we have higher expectations for content that we call cruel and insensitive, which we define as content that targets victims of serious physical or emotional harm.

We remove explicit attempts to mock victims and mark as cruel implicit attempts, many of which take the form of memes and GIFs.

 

INTEGRITY AND AUTHENTICITY 

 

17. Account integrity and authentic identity

Authenticity is the cornerstone of our community. We believe that authenticity helps create a community where people are accountable to each other, and Ekaveer, in meaningful ways. We want to allow for the range of diverse ways that identity is expressed across our global community, while also preventing impersonation and identity misrepresentation. That's why we require people to connect on FEkaveer using the name that they go by in everyday life. Our Authenticity Policies are intended to create a safe environment where people can trust and hold one another accountable.

To maintain a safe environment and empower free expression, we also remove accounts that are harmful to the community, including those that compromise the security of other accounts and our services. We have built a combination of automated and manual systems to block and remove accounts that are used to persistently or egregiously abuse our Community Standards.

Because account-level removal is a harsh severe action, whenever possible, we aim to give our community a chance to learn our rules and follow our Community Standards. Penalties, including account disables, are designed to be proportionate to the severity of the violation and the risk of harm posed to the community. Continued violations, despite repeated warnings and restrictions, or violations that pose severe safety risks, will lead to an account being disabled.

18. Spam

We work hard to limit the spread of spam because we do not want to allow content that is designed to deceive, or that attempts to mislead users to increase viewership. This content creates a negative user experience, detracts from people's ability to engage authentically in online communities, and can threaten the security, stability and usability of our services. We also aim to prevent people from abusing our platform, products or features to artificially increase viewership or distribute content en masse for commercial gain.

19. Cybersecurity

We recognise that the safety of our users extends to the security of their personal information and accounts and our services. Attempts to gather sensitive personal information by deceptive or invasive methods are harmful to the authentic, open and safe atmosphere that we want to foster, and can be used to compromise user accounts and our services. Therefore, we do not allow attempts to gather sensitive user information through the abuse of our platform and products.

20. Inauthentic behaviour

In line with our commitment to authenticity, we don't allow people to misrepresent themselves on Ekaveer, use fake accounts, artificially boost the popularity of content or engage in behaviours designed to enable other violations under our Community Standards. This policy is intended to protect the security of user accounts and our services and create a space where people can trust the people and communities they interact with.

21. False news

Reducing the spread of false news on Ekaveer is a responsibility that we take seriously. We also recognise that this is a challenging and sensitive issue. We want to help people stay informed without stifling productive public discourse. There is also a fine line between false news and satire or opinion. For these reasons, we don't remove false news from Ekaveer, but instead, significantly reduce its distribution by showing it lower in the News Feed.

22. Manipulated media

Media, including image, audio or video, can be edited in a variety of ways. In many cases, these changes are benign, such as a filter effect on a photo. In other cases, the manipulation isn't apparent and could mislead, particularly in the case of video content. We aim to remove this category of manipulated media when the criteria laid out below have been met.

Besides, we will continue to invest in partnerships (including with journalists, academics and independent fact-checkers) to help us reduce the distribution of false news and misinformation, as well as to better inform people about the content they encounter online.

23. Memorialisation

When someone passes away, friends and family can request that we memorialise the Ekaveer account. Once memorialised, the word "Remembering" appears above the name on the person's profile to help make it clear that the account is now a memorial site and to protect against attempted logins and fraudulent activity. To respect the choices that someone made while alive, we aim to preserve their account after they pass away. We have also made it possible for people to identify a legacy contact to look after their account after they pass away. To support the bereaved, in some instances we may remove or change certain content when the legacy contact or family members request it.

RESPECTING INTELLECTUAL PROPERTY

 

24. Intellectual property

Ekaveer takes intellectual property rights seriously and believes that they are important to promoting expression, creativity and innovation in our community. You own all of the content and information that you post on Ekaveer, and you control how it is shared through your privacy and application settings. However, before sharing content on Ekaveer, please make sure that you have the right to do so. We ask that you respect other people's copyrights, trademarks and other legal rights. We are committed to helping people and organisations promote and protect their intellectual property rights. Ekaveer's Terms of Service do not allow people to post content that violates someone else's intellectual property rights, including copyright and trademark. We publish information about the intellectual property reports that we receive in our bi-annual Transparency Report, which can be accessed.

 

CONTENT RELATED REQUESTS AND DECISIONS

 

25. User requests

We comply with:

User requests for removal of their own account.

Requests for removal of a deceased user's account from a verified immediate family member or executor.

26. Additional protection of minors

Requests for removal of an incapacitated user's account from an authorised representative For the following Community Standards, we require additional information and/or context to enforce: We may remove content created to identify a private minor if there may be a risk to the minor's safety when requested by a user, government, law enforcement or external child safety experts.

27. Oversight Board

Is a new model for independent decision-making around what content should be allowed on Ekaveer's platforms. The board's decisions to uphold or reverse our own content decisions will be binding, meaning that we will implement them, unless doing so could violate the law. The Oversight Board's charter calls on them to issue decisions in light of our Community Standards and values.

    

Ekaveer Commercial Terms ("Commercial Terms")

These Commercial Terms apply to access or use of the Ekaveer Products (or "Products"), for a business or commercial purpose (except where we state that separate terms, and not these Commercial Terms, apply to such access or use of an Ekaveer Product). Business or commercial purposes include using ads, selling products, developing apps, managing a Page, managing a Group for business purposes, or using our measurement services regardless of the entity type.

You agree that you will ensure that any third party on whose behalf you access or use any Ekaveer Product for any business or commercial purpose will abide by the applicable terms of use, including these Commercial Terms, the Ekaveer Terms of Service (“Terms”), and any applicable supplemental terms, and you represent and warrant that you have the authority to bind that third party to such terms.

As more fully described below, if you reside in the United States or your business is located in the United States, these Commercial Terms require the resolution of most disputes between you and us by binding arbitration on an individual basis; class actions and jury trials are not permitted.

Licenses: As described in “The permissions you give us” section in our Terms, you grant us a license to content that is covered by intellectual property rights (like photos or videos) you share, post, or upload on or in connection with our Ekaveer Products. For any access or use of the Ekaveer Products, that license applies to content you or someone on your behalf (such as your agency that places an ad for you or your service provider that manages your Page content for you) makes available on or in connection with any Ekaveer Product. You also will ensure that you own or have secured all rights necessary to grant the licenses and rights you (or someone on your behalf) grant to us under the Commercial Terms and any applicable supplemental terms, including permission to display, distribute and deliver your content within Ekaveer Products.

Compliance with Law: You represent and warrant that your access or use of Ekaveer Products for business or commercial purposes complies with all applicable laws, rules, and regulations. You further represent that you will restrict access to your content and apps by all applicable laws, rules, and regulations, including geo-filtering or age-gating access where required. In addition to and without limiting the requirements about who can use the Ekaveer Products under our Terms, if you are located in a country that is subject to embargo under the laws of the United States (or under similar laws applicable to you) you may not engage in commercial activities on Ekaveer Products unless authorized by applicable laws. If you are on the U.S. Treasury Department’s list of Specially Designated Nationals (or an equivalent list), you may not engage in commercial or business activities on the Ekaveer Products (such as advertising or payments). You also may not access or use the Ekaveer Products if you are prohibited from receiving products, services, or software under applicable law.

Data Restrictions: You may not send us information prohibited by the supplemental terms or policies. Also, you may not send to us, or use Ekaveer Products to collect from people, information that: (i) you know or reasonably should know is from or about children under the age of 13; or (ii) includes health, financial, biometrics, or other categories of similarly sensitive information (including any information defined as sensitive under applicable law); except in cases where (a) the terms for that Ekaveer Product specifically allow it or (b) you are sending financial information for the express purpose of effecting a financial transaction either with us or as enabled by an Ekaveer Product.

Limits on Liability: In addition to and without limiting the scope of the “Limits on liability” section in our Terms, you agree that we are not responsible for the actions, services, content, or data of third parties and you release us, our directors, officers, employees, and agents from any claims and damages, known or unknown, arising out of or in any way connected with any claim you have against any such third parties.

If you are a California resident, you agree to waive California Civil Code § 1542, which says:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.

Disputes:

Third-Party Claims: If anyone brings a claim, cause of action, or dispute against us related to your services, actions, content or information on Ekaveer or other Ekaveer Products or your use of any Ekaveer Products, you agree to indemnify and hold us harmless from and against any damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to any such claim, cause of action, or dispute.

Commercial Claims: Sections 5.c and 5.d below apply to any claim, cause of action, or dispute that arises out of or relates to any access or use of the Ekaveer Products for business or commercial purposes (“Commercial Claim”) between you and Ekaveer.

We and you agree that, by entering into this arbitration provision, all parties are waiving their respective rights to a trial by jury or to participate in a class or representative action. THE PARTIES AGREE THAT EACH MAY BRING COMMERCIAL CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.

Without prejudice to the foregoing, you agree that, in our sole discretion, we may also bring any claim we have against you related to efforts to abuse, interfere, or engage with our Products in unauthorized ways in the country in which you reside that has jurisdiction over the claim.

Severability: If any provision of this Section 5 is found unenforceable, that provision will be severed and the balance of this Section 5 will remain in full force and effect.

Updates: We may need to update these Commercial Terms from time to time, including to accurately reflect the access or uses of our Products for business or commercial purposes, and so we encourage you to check them regularly for any updates. By continuing any access or use of any Ekaveer Products for business or commercial purposes after any notice of an update to these Commercial Terms, you agree to be bound by them. Any updates to Section 5 of these Commercial Terms will apply only to disputes that arise after notice of the update takes place. If you do not agree to the updated terms, please stop all access or use of our Products for business or commercial purposes.

Conflicts and Supplemental Terms: If there is a conflict between these Commercial Terms and the Terms, these Commercial Terms will govern concerning your access and use of the Ekaveer Products for business or commercial purposes to the extent of the conflict. Supplemental terms and policies may also apply to your use of certain Ekaveer Products. To the extent those supplemental terms conflict with the Commercial Terms, the supplemental terms will govern concerning your use of those Ekaveer Products to the extent of the conflict.

If any portion of these Commercial Terms is found to be unenforceable, then (except as otherwise provided) that portion will be severed and the remaining portion will remain in full force and effect.

If we fail to enforce any of these Commercial Terms, it will not be considered a waiver.

Except as permitted in Section 6, any amendment to or waiver of these Commercial Terms must be made in writing and signed by us.

You will not transfer any of your rights or obligations under these Commercial Terms to anyone else without our consent.

Except as set out in the Data Transfer Addendum, these Commercial Terms do not confer any third-party beneficiary rights.

We offer tools to provide transparency and controls to our users about the Ekaveer experience, including information to show them why they are being shown specific content or provide feedback about content, and controls to block content or stop seeing certain types of content (such as by removing themselves from interests used for advertising). You agree that information about you and your use of Ekaveer for commercial or business purposes may be included in these tools. For clarity, our content license extends to the display of content in conjunction with providing these tools.

You consent that Ekaveer may disclose your advertising content and Page posts (“Commercial Content”), and all information associated with such Commercial Content, including information associated with the delivery of that Commercial Content, in response to valid legal process related to an electoral matter or a governmental entity or body if Ekaveer believes that disclosure would assist in a lawful investigation.

Please note that our retention policies for Commercial Content may differ from those outlined in the Terms. We retain Commercial Content as necessary to provide our services to users, for internal recordkeeping, and product improvement and safety purposes.

All of our rights and obligations under these Commercial Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

Nothing in these Commercial Terms or any applicable supplemental terms will prevent us from complying with the law.

We reserve all rights not expressly granted to you.

Note: For purposes of these Commercial Terms, references in existing terms or agreements to (i) “the Statement of Rights and Responsibilities,” “Statement,” or “SRR,” will now mean the Ekaveer Terms or Terms and (ii) “Ekaveer” (when used to refer to our products and services) or “Ekaveer Services” or “Services” will now mean Ekaveer Products.

 

MUSIC GUIDELINES

These supplemental terms apply if you post or share any videos or other content containing music on any Ekaveer Products.

You are responsible for the content you post

People use our Products to share content with their family and friends. Keep in mind you remain solely responsible for the content that you post, including any music that features in that content. Nothing in these terms constitutes any authorization by us concerning any use of music on any of our Products.

Use of music for commercial or non-personal purposes, in particular, is prohibited unless you have obtained appropriate licenses.

You may not use videos on our Products to create a music listening experience

We want you to be able to enjoy videos posted by family and friends. However, if you use videos on our Products to create a music listening experience for yourself or others, your videos will be blocked and your page, profile or group may be deleted. This includes Live.

Unauthorized content may be removed

If you post content that contains music owned by someone else, your content may be blocked or may be reviewed by the applicable rights owner and removed if your use of that music is not properly authorized.

You may not be able to post or access videos containing music in every country of the world

We want you to be able to share videos with your family and friends wherever they are, but any music in your video, if it is allowed at all, may not be available in all countries of the world.

 

EKAVEER LIVE POLICIES

 

1. Overview

Understanding our policies

The following terms, as well as our Data Policy, Community Standards, and Terms of Service, apply to all users on Ekaveer. You are responsible for ensuring that your content complies with all applicable laws, statutes, and regulations.

2. General Policies for Ekaveer Live

Prohibited Practices

Ekaveer Live must not be used to mislead users that specific footage is occurring in real-time when it is not.

Example:

Misrepresenting footage of an event that occurred a year ago as currently happening

Inaccurate Location

Ekaveer Live must not be used to mislead users that specific footage is happening in a particular locale when it is not.

Example:

Misrepresenting footage from a different country as footage from the United States

Pre-recorded Content

All pre-recorded content contained in a broadcast streamed to Ekaveer Live must be clearly marked as pre-recorded. For broadcasts that contain a mixture of live footage and pre-recorded footage, only the pre-recorded footage must be marked as pre-recorded.

Example:

Adding a graphic to mark specific footage as pre-recorded

Including a disclaimer in the video description or title that specific content is pre-recorded

Looping or Static Content

Ekaveer Live should not be used to broadcast looping videos, static images, or poll-only videos.

Example:

Streaming a 20-minute clip that is continuously looped

A broadcast that is limited to a photo and has no other auditory or visual elements

A broadcast that only contains a poll

 

COMMERCE POLICIES

 

1.Overview

Understanding Our Policies

Products sold on Ekaveer must comply with our Commerce Policies. Additionally, products sold on Ekaveer must comply with Ekaveer's Community Standards. Our Commerce Policies provide rules on the types of products and services that can be offered for sale on Ekaveer. Buyers and sellers are also responsible for complying with all applicable laws and regulations. Failure to comply may result in a variety of consequences, including, but not limited to, removal of listings and other content, rejection of product tags, or suspension or termination of access to any or all Ekaveer commerce surfaces or features. If you repeatedly post content that violates our policies, we may take additional action on your account. We reserve the right to reject, approve, or remove any listing for any reason at any time, in our sole discretion.

 

2.Steps to Take if Disapproved

If your listing has been rejected for violating our Commerce Policies and you feel it was a mistake, you can request a review by following these steps for Marketplace or these steps for Instagram and we'll take another look.

 

3.Prohibited Content

Buying or selling of the following is prohibited on Ekaveer commerce surfaces and features:

Listings may not promote the buying, selling, or use of adult products.

Listings may not promote the buying or selling of alcohol.

Listings may not promote the buying or selling of animals.

Listings may not promote the buying or selling of human body parts or fluids.

6.Digital Media and Electronic Devices

Listings may not promote the buying or selling of devices that facilitate or encourage streaming digital content in an unauthorized manner or interfering with the functionality of electronic devices.

7.Discrimination

Listings, and commerce Messenger threads, must not wrongfully discriminate or suggest a preference for or against people because of a personal characteristic, included but not limited to, race, ethnicity, colour, national origin, citizenship, religion, age, sex, sexual orientation, gender identity, family status, marital status, disability, or medical or genetic condition. Listings must comply with all applicable laws prohibiting discrimination. This includes but is not limited to discrimination for housing listings.

8.Documents, Currency, and Financial Instruments

Listings may not promote the buying or selling of real or fake documents, currency, financial instruments and virtual currency

9.Gambling

Listings may not promote the buying, selling or facilitation of online gambling for money or money's worth, including digital currencies. Online gambling includes gaming, betting, lotteries, raffles, casino, fantasy sports, bingo, poker and sweepstakes in an online environment.

10.Hazardous Goods and Materials

Listings may not promote the buying or selling of hazardous materials and substances.

11.Human Exploitation and Sexual Services

Listings may not promote any form of human trafficking, prostitution, escort, or sexual services.

12.Ingestible Supplements

Listings may not promote the buying or selling of ingestible supplements.

13.Jobs

Listings on commerce products may not promote job opportunities. This prohibition includes job opportunities that fully describe the associated product or business model, as well as job opportunities that are misleading, deceptive, fraudulent or have an unclear business model.

14.Medical and Healthcare Products

Listings may not promote medical and healthcare products and services, including medical devices, or smoking cessation products containing nicotine.

15.Misleading, Violent, or Hateful

Listings may not contain misleading, violent, or hateful products and offers.

16.No Item for Sale

Listings may not promote news, humour, or other content that does not offer any product for sale.

17.Prescription Products, Drugs, and Drug Paraphernalia

Listings may not promote the buying or selling of drugs, drug paraphernalia, or prescription products.

18.Products with Overtly Sexualized Positioning

Listings may not position products or services in a sexually suggestive manner.

19.Recalled Products

Listings may not promote the buying or selling of recalled products.

20.Services

Services may not be listed.

21.Stolen Goods

Listings may not promote the buying or selling of items that have been stolen.

22.Subscriptions and Digital Products

Listings may not promote the buying or selling of downloadable digital content, digital subscriptions, and digital accounts.

23.Third-Party Infringement

Listings may not contain content that infringes upon or violates the intellectual property rights of any third party, including copyright or trademark. This includes, but is not limited to, the promotion or sale of counterfeits, such as goods that copy the trademark (name or logo) and/or distinctive features of another company’s products to imitate a genuine product.

24.Tobacco Products and Related Paraphernalia

Listings may not promote the buying or selling of tobacco products or tobacco paraphernalia.

25.Weapons, Ammunition, and Explosives

Listings may not promote the buying, selling, or use of weapons, ammunition, and explosives.

 

4.Restricted Content

The sale of the following is restricted on Ekaveer Commerce Products:
