Welcome to Ekaveer’ Privacy Policy

  1. Hi there, we’re Ekaveer and welcome to our privacy policy. This policy sets out how we handle your personal information if you’re the Ekaveer user or visitor to our website. 
  2. By ‘we’, ‘us’ in this policy, we mean ‘Ekaveer’.
  3. If we say ‘policy’ we’re talking about this privacy policy. If we say ‘user terms’ we’re talking about the rules for using this website. 
  4. Both personal information and personal data have the same meaning in the context of this privacy policy. 

The type of personal information we collect

  1. We collect certain personal information about visitors and users of our website. 
  2. The most common types of information we collect include things like: member names, email addresses, phone numbers, IP addresses, billing address details, payment information such as payment agent details, transactional details, support queries, website administration information, app store account credentials, server information and web analytics data.

How we collect personal information

  1. We collect personal information directly when you provide it to us, automatically as you navigate through the website, or through other people when you use services associated with the website. 
  2. We collect your personal information when you provide it to us when you complete registration and buy products or services on our website, subscribe to a newsletter, email list, submit feedback, submit a support ticket, enter a contest, fill out a survey, or send us a communication.

Personal information we collect about you from others

  1. Although we generally collect personal information directly from you, on occasion, we also collect certain categories of personal information about you from other sources. In particular: 
    a. financial and/or transaction details from payment providers in order to process a transaction; 
    b. other third party sources/ and or partners, whereby we receive additional information about you (to the extent permitted by applicable law), such as demographic data or fraud detection information, and combine it with information we have about you. For example, fraud warnings from service providers like identity verification service. We also receive information about you and your activities on and off the Ekaveer website through partnerships, or about your experiences and interactions from our partner ad networks. We also receive information about you as a rights holder from our third-party partners when you purchase our products or services from them. 

How we use personal information

  1. We will use your personal information: 
    a. To fulfil an order or a contract, or take steps linked to a contract: in particular, in facilitating and processing transactions that take place on the website, like where you purchase an item from our store. 
    b. Where this is necessary for purposes which are in our, or third parties, legitimate interests. These interests include: 
    i. operating the website; 
    ii. providing you with services described on the website; 
    iii. verifying your identity when you sign in to our website; 
    iv. responding to support tickets, and helping facilitate the resolution of any disputes; 
    v. updating you with operational news and information about our website, products and services e.g. to notify you about changes to our website, upgrade of the product purchased by you, website disruptions or security updates; 
    vi. carrying out technical analysis to determine how to improve the website, products and services we provide; 
    vii. monitoring activity on the website, e.g. to identify potential fraudulent activity and to ensure compliance with the user terms that apply to the website; 
    viii. managing our relationship with you, e.g. by responding to your comments or queries submitted to us on the website or asking for your feedback or whether you want to participate in a contest or survey; 
    ix. managing our legal and operational affairs (including, managing risks relating to content and fraud matters); 
    x. training our staff about how to best serve our customers; 
    xi. improving our products and services, and xii. providing general administrative, support, performance functions and activities. 
    c. Where you give us consent: 
    i. providing you with marketing information about products and services which we feel may interest you; and 
    ii. customising our services and websites, like recommendations and advertising that appear on the website – where this involves the use of cookies or similar technologies – in order to provide a more personalised experience. 
    d. For purposes which are required by law. 
    e. For the purpose of responding to requests by the government, a court of law, or law enforcement authorities conducting an investigation. 

When we disclose your personal information

  1. We will disclose personal information to the following recipients: 
    a. Companies and ventures that are in the “Ekaveer”; 
    b. service providers who assist us in connection with the ways we use personal information (as set out above), in particular: website hosting providers; marketing and analytics services; security and fraud prevention services; payment processing services. 
    c. our professional advisers (lawyers, accountants, financial advisers etc.); 
    d. regulators and government authorities in connection with our compliance procedures and obligations; 
    e. a purchaser or prospective purchaser of all or part of our assets or our business, and their professional advisers, in connection with the purchase; 
    f. a third party to respond to requests relating to a criminal investigation or alleged or suspected illegal activity; 
    g. a third party, in order to enforce or defend our rights, or to address financial or reputational risks; 
    h. a rights holder in relation to an allegation of intellectual property infringement or any other infringement; and 
    i. other recipients where we are authorised or required by law to do so. 

Where we transfer and/or store your personal information

  1. We are based in Montenegro with our servers based in Germany so your data will be processed in Montenegro and Germany. Some of the recipients we have described in section 10 above, and to whom we disclose your personal information, are based outside Montenegro in places like Germany. We do this on the basis of your consent to this policy. In order to protect your information, we take care where possible to work with service providers who we believe maintain an acceptable standard of data security compliance. 
    Data that flows between each of your sub-processors is done on the server-side of our operation. This information is never cached and is sent directly to the subprocessor using a secure connection and private keys provided by the subprocessor. These private keys are never stored on any of the servers in flat files.

How you can access your personal information

  1. You can access some of the personal information that we collect about you by logging in to your account. You also have the right to make a request to access other personal information we hold about you and to request corrections of any errors in that data. You can also close the account you have with us at any time. To make an access or correction request, contact our privacy inspector using the contact details at the end of this policy.

Marketing Choices regarding your personal information

  1. Where we have your consent to do so (e.g. if you have subscribed to one of our e-mail lists or have indicated that you are interested in receiving offers or information from us), we send you marketing communications by email about products and services that we feel may be of interest to you. You can ‘opt-out’ of such communications if you would prefer not to receive them in the future by using the “unsubscribe” facility provided in the communication itself. 
  2. You also have choices about cookies, as described below. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject cookies some parts of our website may not work properly in your case.

  2. When you visit our website, there’s certain information that’s recorded which is generally anonymous information and does not reveal your identity. If you’re logged into your account some of this information could be associated with your account. We’re talking about the following kinds of details:

    b. the URL you requested; 
    c. the name of your internet service provider is sometimes captured depending on the configuration of your ISP connection; 
    d. the date and time of your visit to the website; 
    e. the length of your session; 
    f. the pages which you have accessed; 
    g. the number of times you access our site within any month; 
    h. the URL you look at and information relating to it; 
    i. the website which referred you to our website; and 
    j. the operating system which your computer uses.

Information about children

  1. Our website is not suitable for children under the age of 13 years, so if you are under 16 we ask that you do not use our website or give us your personal information. If you are from 13 to 18 years, you can browse the website but you’ll need the supervision of a parent or guardian to become a registered user. It’s the responsibility of parents or guardians to monitor their children’s use of our Sites.

Information you make public or give to others

  1. If you make your personal information available to other people, we can’t control or accept responsibility for the way they will use or manage that data. There are lots of ways that you can find yourself providing information to other people, like when you post a comment or share information via social media. Before making your information publicly available or giving your information to anyone else, think carefully. If you’re sharing information via another website, check the privacy policy for that website to understand its information management practices as this privacy policy will not apply.

How long we keep your personal information

  1. We retain your personal information for as long as is necessary to provide the services to you and others, and to comply with our legal obligations. If you no longer want us to use your personal information or to provide you with the Ekaveer services, you can request that we erase your personal information and close your Ekaveer account. Please note that if you request the erasure of your personal information we will retain information from deleted accounts as necessary for our legitimate business interests, to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the terms of service and take other actions permitted by law. The information we retain will be handled in accordance with this Privacy Policy.

When we need to update this policy

  1. We will need to change this policy from time to time in order to make sure it stays up to date with the latest legal requirements and any changes to our privacy management practices. 
  2. When we do change the policy, we’ll make sure to notify you about such changes, where required. A copy of the latest version of this policy will always be available on this page.

If you’re a user or visitor in the European Economic Area these rights also apply to you:

  1. For the purposes of applicable EU data protection law (including the General Data Protection Regulation 2016/679 (the “GDPR”), we are a ‘data controller of your personal information. How you can access your personal information 
  2. You are also entitled to ask us to port your personal information (i.e. to transfer in a structured, commonly used and machine-readable format, to you), to erase it, or restrict its processing. You also have the rights to object to some processing that is based on our legitimate interests, such as profiling that we perform for the purposes of direct marketing, and, where we have asked for your consent to process your data, to withdraw this consent as more fully described below. 
  3. These rights are limited in some situations – for example, we can demonstrate that we have a legal requirement to process your personal information. In some instances, this means that we may retain some data even if you withdraw your consent. 
  4. Where we require your personal information to comply with legal or contractual obligations, then provision of such data is mandatory: if such data is not provided, then we will not be able to manage our contractual relationship with you or to meet obligations placed on us. In all other cases, the provision of requested personal information is optional. 
  5. If you have unresolved concerns you also have the right to complain to data protection authorities. The relevant data protection authority will be the data protection authority of the country: (i) of your habitual residence; (ii) of your place of work; or (iii) in which you consider the alleged infringement has occurred. 

 

Data Policy

This Policy describes the information we process to support Ekaveer.

What kinds of information do we collect?

To provide the Ekaveer, we must process information about you. The type of information that we collect depends on how you use our Products. You can learn how to access and delete information that we collect by visiting the Ekaveer settings with click https://www.ekaveer.com/users/profile.

Things that you and others do and provide.

Information and content you provide. We collect the content, communications and other information you provide when you use our Products, including when you sign up for an account, create or share content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created. It can also include what you see through features we provide, such as our camera, so we can do things like suggest masks and filters that you might like or give you tips on using camera formats. Our systems automatically process content and communications you and others provide to analyze context and what's in them for the purposes described below. Data with special protections: You can choose to provide information in your Ekaveer profile fields bout your religious views, political views, who you are "interested in," or your health. This and other information (such as racial or ethnic origin, philosophical beliefs or trade union membership) could be subject to special protections under the laws of your country.

Networks and connections. We collect information about the people, Pages, accounts, hashtags and groups you are connected to and how you interact with them across our Products, such as people you communicate with the most or groups you are part of. We also collect contact information if you choose to upload, sync or import it from a device (such as an address book or call log or SMS log history), which we use for things like helping you and others find people you may know and for the other purposes listed below.

Your usage. We collect information about how you use our Products, such as the types of content you view or engage with; the features you use; the actions you take; the people or accounts you interact with; and the time, frequency and duration of your activities. For example, we log when you're using and have last used our Products, and what posts, videos and other content you view on our Products. We also collect information about how you use features like our camera.

Information about transactions made on our Products. If you use our Products for purchases or other financial transactions (such as when you make a purchase in a game or make a donation), we collect information about the purchase or transaction. This includes payment information, such as your credit or debit card number and other card information; other account and authentication information; and billing, shipping and contact details.

This can include information about you, such as when others share or comment on a photo of you, send a message to you or upload, sync or import your contact information.

Device information.

As described below, we collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our Products, and we combine this information across different devices that you use. For example, we use information collected about your use of our Products on your phone to better personalise the content (including ads) or features that you see when you use our Products on another device, such as your laptop or tablet, or to measure whether you took an action in response to an ad that we showed you on your phone on a different device.

Information that we obtain from these devices includes:

Device attributes information such as the operating system, hardware and software versions, battery level, signal strength, available storage space, browser type, app and file names and types, and plugins.

Device operations: information about operations and behaviours performed on the device, such as whether a window is in the foreground or background, or mouse movements (which can help distinguish humans from bots).

Identifiers: unique identifiers, device IDs and other identifiers, such as from games, apps or accounts that you use, and Family Device IDs (or other identifiers unique to Ekaveer Company Products associated with the same device or account).

Device signals: Bluetooth signals, information about nearby Wi-Fi access points, beacons and mobile phone masts.

Data from device settings: information you allow us to receive through device settings that you turn on, such as access to your GPS location, camera or photos.

Network and connections: information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, IP address, connection speed and, in some cases, information about other devices that are nearby or on your network, so we can do things such as help you stream a video from your phone to your TV.

Cookie data: data from cookies stored on your device, including cookie IDs and settings. Learn more about how we use cookies in the Ekaveer Cookies.

Information from partners.

Advertisers, app developers and publishers can send us information through Ekaveer tools that they use, including our social plug-ins (such as the Like button), Ekaveer Login, our APIs and SDKs. These partners provide information about your activities off Ekaveer – including information about your device, websites you visit, purchases you make, the ads you see and how you use their services – whether or not you have the Ekaveer account or are logged in to Ekaveer. For example, a game developer could use our API to tell us what games you play, or a business could tell us about a purchase you made in its shop. We also receive information about your online and offline actions and purchases from third-party data providers who have the rights to provide us with your information.

Partners receive your data when you visit or use their services, or through third parties that they work with. We require each of these partners to have lawful rights to collect, use and share your data before providing us with any data. Learn more about the types of partners we receive data from.

How do we use this information?

We use the information that we have (subject to choices you make) as described below, and to provide and support the Ekaveer Products and related services described in the Ekaveer Terms. Here's how:

Provide, personalise and improve our Products.

We use the information we have to deliver our Products, including personalize features and content (including your News Feed and ads) and make suggestions for you (such as groups or events you may be interested in or topics you may want to follow) on and off our Products. To create personalized Products that are unique and relevant to you, we use your connections, preferences, interests and activities based on the data we collect and learn from you and others (including any data with special protections you choose to provide); how you use and interact with our Products; and the people, places, or things you're connected to and interested in on and off our Products.

Location-related information: We use location-related information-such as your current location, where you live, the places you like to go, and the businesses and people you're near-to provide, personalize and improve our Products, including ads, for you and others. Location-related information can be based on things like precise device location (if you've allowed us to collect it), IP addresses, and information from your and others' use of Ekaveer Products (such as check-ins or events you attend).

Product research and development: We use the information we have to develop, test and improve our Products, including by conducting surveys and research, and testing and troubleshooting new products and features.

Providing measurement, analytics and other business services.

We use the information we have (including your activity of our Products, such as the websites you visit and ads you see) to help advertisers and other partners measure the effectiveness and distribution of their ads and services, and understand the types of people who use their services and how people interact with their websites, apps and services. Promote safety, integrity and security.

We use the information that we have to verify accounts and activity, combat harmful conduct, detect and prevent spam and other bad experiences, maintain the integrity of our Products, and promote safety and security on and off Ekaveer. For example, we use data that we have to investigate suspicious activity or breaches of our Terms or Policies, or to detect when someone needs help.

Communicate with you.

We use the information that we have to send you marketing communications, communicate with you about our products and let you know about our Policies and Terms. We also use your information to respond to you when you contact us.

Research and innovate for social good.

We use the information we have (including from research partners we collaborate with) to conduct and support research and innovation on topics of general social welfare, technological advancement, public interest, health and well-being. Sharing on Ekaveer

People and accounts that you share and communicate with

When you share and communicate using our Products, you choose the audience for what you share. For example, when you post on Ekaveer, you select the audience for the post, such as a group, all of your friends, the public or a customised list of people. Your network can also see actions that you have taken on Ekaveer, including engagement with ads and sponsored content. We also let other accounts see who has viewed their Ekaveer account.

Public information can be seen by anyone, on or off our Products, including if they don't have an account. This includes your Ekaveer username, any information you share with a public audience, the information in your public profile on Ekaveer, and content you share on an Ekaveer Page or any other public forum, such as Ekaveer Stores. You, other people using Ekaveer, and we can provide access to or send public information to anyone on or off our Products in search results or through tools and APIs. Public information can also be seen, accessed, reshared or downloaded through third-party services such as search engines, APIs and offline media such as TV, and by apps, websites and other services that integrate with our Products.

Content that others share or reshare about you.

You should consider who you choose to share with, because people who can see your activity on our Products can choose to share it with others on and off our Products, including people and businesses outside the audience that you shared with. For example, when you share a post or send a message to specific friends or accounts, they can download, screenshot or reshare that content to others across or off our Products, in person or virtual reality experiences. Also, when you comment on someone else's post or react to their content, your comment or reaction is visible to anyone who can see the other person's content, and that person can change the audience later.

People can also use our Products to create and share content about you with the audience they choose. For example, people can share a photo of you, mention or tag you at a location in a post, or share information about you in their posts or messages. If you are uncomfortable with what others have shared about you on our Products, you can learn how to report the content.

Information about your active status or presence on our Products.

People in your networks can see signals telling them whether you are active on our Products or when you last used our Products.

Apps, websites and third-party integrations on or using our Products.

When you choose to use third-party apps, websites or other services that use or are integrated with, our Products, they can receive information about what you post or share. For example, when you play a game with your Ekaveer friends, the game developer or website can receive information about your activities in the game or receive a comment or link that you share from the website on Ekaveer. Also, when you download or use such third-party services, they can access your public profile on Ekaveer, and any information that you share with them. Apps and websites that you use may receive your list of Ekaaveer friends if you choose to share it with them. But apps and websites that you use will not be able to receive any other information about your Ekaveer friends from you, or information about any of your Ekaveer followers (although your friends and followers may, of course, choose to share this information themselves). Information collected by these third-party services is subject to their terms and policies, not this one.

Devices and operating systems providing native versions of Ekaveer (i.e. where we have not developed our first-party apps) will have access to all information that you choose to share with them, including information that your friends share with you, so they can provide our core functionality to you.

Note: We are in the process of restricting developers' data access even further to help prevent abuse. For example, we will remove developers' access to your Ekaveer data if you haven't used their app in three months, and we are changing login so that in the next version, we will reduce the data that an app can request without app review to include the only name. Requesting any other data will require our approval.

New owner.

If the ownership or control of all or part of our Products or their assets changes, we may transfer your information to the new owner.

Sharing with third-party partners

We work with third-party partners who help us provide and improve our Products or who use Ekaveeer Tools to grow their businesses, which makes it possible to operate our companies and provide free services to people around the world. We don't sell any of your information to anyone and we never will. We also impose strict restrictions on how our partners can use and disclose the data we provide. Here are the types of third parties that we share information with:

Partners who use our analytics services.

We provide aggregated statistics and insights that help people and businesses understand how people are engaging with their posts, listings, Pages, videos and other content on and off the Ekaveer Products. For example, Page admins receive information about the number of people or accounts who viewed, reacted to or commented on their posts, as well as aggregate demographic and other information that helps them understand interactions with their Page or account.

Advertisers.

We provide advertisers with reports about the kinds of people seeing their ads and how their ads are performing, but we don't share information that personally identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you permit us. For example, we provide general demographic and interest information to advertisers (for example, that an ad was seen by a woman between the ages of 25 and 34 who lives in London and likes software engineering) to help them better understand their audience. We also confirm which Ekaveer ads led you to make a purchase or take an action with an advertiser.

Measurement partners.

We share information about you with companies that aggregate it to provide analytics and measurement reports to our partners.

Partners offering goods and services in our Products.

When you subscribe to receive premium content or buy something from a seller in our Products, the content creator or seller can receive your public information and other information that you share with them, as well as the information needed to complete the transaction, including shipping and contact details.

Vendors and service providers.

We provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, analysing how our Products are used, providing customer service, facilitating payments or conducting surveys.

Researchers and academics.

We also provide information and content to research partners and academics to conduct research that advances scholarship and innovation that supports our business or mission and enhances discovery and innovation on topics of general social welfare, technological advancement, public interest, health and well-being.

Law enforcement or legal requests.

We share information with law enforcement or in response to legal requests in the circumstances outlined below.

How can I manage or delete information about myself?

We provide you with the ability to access, rectify, port and delete your data.

We store data until it is no longer necessary to provide our services and Ekaveer Products or until your account is deleted – whichever comes first. This is a case-by-case determination that depends on things such as the nature of the data, why it is collected and processed, and relevant legal or operational retention needs. For example, when you search for something on Ekaveer, you can access and delete that query from within your search history at any time, but the log of that search is deleted after six months.

When you delete your account, we delete things that you have posted, such as your photos and status updates, and you won't be able to recover this information later. Information that others have shared about you isn't part of your account and won't be deleted. If you don't want to delete your account but want to temporarily stop using the Products, you can deactivate your account instead.

How do we respond to legal requests or prevent harm?

We access, preserve and share your information with regulators, law enforcement or others:

In response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions when we have a good-faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.

When we have a good-faith belief it is necessary to: detect, prevent and address fraud, unauthorized use of the Products, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, property or Products), you or others, including as part of investigations or regulatory inquiries; or to prevent death or imminent bodily harm. For example, if relevant, we provide information to and receive information from third-party partners about the reliability of your account to prevent fraud, abuse and other harmful activity on and off our Products.

We also retain information from accounts disabled for term breaches for at least a year to prevent repeat abuse or other term breaches.

How do we operate and transfer data as part of our global services?

We utilise standard contract clauses, rely on the European Commissions adequacy decisions about certain countries, as applicable, and obtain your consent for these data transfers to the United States and other countries.

How will we notify you of changes to this Policy?

We'll notify you before we make changes to this Policy and allow you to review the revised Policy before you choose to continue using our Products.

Cookies & other storage technologies

Cookies are small pieces of text used to store information on web browsers. Cookies are used to store and receive identifiers and other information on computers, phones, and other devices. Other technologies, including data that we store on your web browser or device, identifiers associated with your device and other software, are used for similar purposes. In this policy, we refer to all of these technologies as "cookies".

We use cookies if you have an Ekaveer account, use the Ekaveer Products, including our website and apps, or visit other websites and apps that use the Ekaveer Products (including the Like). Cookies enable Ekaveer to offer the Ekaveer Products to you and to understand the information that we receive about you, including information about your use of other websites and apps, whether or not you are registered or logged in.

This policy explains how we use cookies and the choices you have. Except as otherwise stated in this policy, the Data Policy will apply to our processing of the data that we collect via cookies.

Why do we use cookies?

Cookies help us provide, protect and improve the Ekeveer Products, such as by personalising content, tailoring and measuring ads, and providing a safer experience. The cookies that we use include session cookies, which are deleted when you close your browser, and persistent cookies, which stay in your browser until they expire or you delete them. While the cookies that we use may change from time to time as we improve and update the Ekaveer Products, we use them for the following purposes:

Authentication

We use cookies to verify your account and determine when you're logged in so that we can make it easier for you to access the Ekaveer Products and show you the appropriate experience and features.

For example, We use cookies to keep you logged in as you navigate between Ekaveer Pages. Cookies also help us remember your browser so you don't have to keep logging in to Ekaveer and so you can more easily log in to Ekaveer via third-party apps and websites

Security, site and product integrity

We use cookies to help us keep your account, data and the Ekaveer Products safe and secure.

For example, Cookies can help us identify and impose additional security measures when someone may be attempting to access an Ekaveer account without authorisation, for instance, by rapidly guessing different passwords.
